The services provided by BSPL are subject to the following Terms and Conditions (the "Terms").
    2. By using our website, you accept these terms and conditions in full; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use our website.
    3. If you register with our website, submit any material to our website or use any of our website services, we will ask you to expressly agree to these terms and conditions.
    4. You must be at least (18) years of age to use our website; by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least (18) years of age.
    5. Our website uses cookies; by using our website or agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our privacy and cookies policy.

  2. Services

    BSPL makes the Site (a platform) available as a service to Users. When you register on this site, BSPL grants you a limited, revocable, nonexclusive licence to use this site/service. Our service helps Employers to find the right candidate required by them by viewing Workers’ profiles which include their CV, experience, video interview, etc.; interviewing the candidate, and sending information to chosen candidates directly through in-Built Broadcasting tool. Workers can either submit their contact numbers from the Site when Asia Workers team will get in touch for the details; or submit the details through the App which can be downloaded from Google Playstore.


  3. Fee

    At present, BSPL does not charge any fee for registration. However, Employers have to register to use our services.


  4. Licence to use website
    1. You may:
      1. view pages from our website in a web browser
      2. download pages from our website for caching in a web browser
      3. print pages from our website
      4. stream audio and video files from our website and
      5. use our website services by means of a web browser,subject to the other provisions of these terms and conditions.
    2. Except as expressly permitted by the provisions of these terms and conditions, you must not download any material from our website or save any such material to your computer.
    3. You may only use our website for your own personal and business purposes, and you must not use our website for any other purposes.

  6. Registration and accounts
    1. To access services through our Site, an Employer must register as “User” and have a Member Account. In the registration form provided on the site, you are required to fill in Company Name, Company Website, Email, Country code, Address, Country, State, City, Zip code etc. When you register, you agree to provide true, accurate and complete information. You agree and confirm that you are a legal entity. You agree to update this information as and when changes occur.
    2. You may register for an account with our website by completing and submitting the account registration form on our website, and clicking on the verification link in the email that the website will send to you.
    3. You must not allow any other person to use your account to access the website.
    4. You must notify us in writing immediately if you become aware of any unauthorised use of your account.
    5. Each User represents, warrants, and agrees to grant access to the Account only to persons authorized to act on behalf of the User and only in accordance with this Agreement. The User agrees to be fully responsible and liable for any action using User’s Account.

    1. Some areas of the Site allow Employers to post/upload their Company details and the content for broadcast and send SMS to Workers. You acknowledge and agree that you are solely responsible for all the Content that you upload and make available through the Site.
    2. Information control: BSPL generally will not review, edit or delete any content posted by Users on the Site. But, it reserves the right to modify or delete such content which is considered offensive, harmful, inaccurate, or deceptive and in its sole discretion, violates these provisions. By using the Site, you agree that BSPL is not responsible for any acts or omissions of Users on the Site.
    3. BSPL does not claim any ownership rights in any such User Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such User Content. You understand and agree, however, that BSPL may retain, but not display, distribute, or perform, server copies of User Content that have been removed or deleted.
    4. In these terms and conditions, "your content" means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files) that you submit to us or our website for storage or publication on, processing by, or transmission via, our website.
    5. You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media OR reproduce, store and publish your content on and in relation to this website and any successor website OR reproduce, store and, with your specific consent, publish your content on and in relation to this website.

User agrees and acknowledges that BSPL shall not be liable, under any circumstances, to any other party, including the User, for direct, indirect, incidental, consequential, special or exemplary damages arising from or concerning any Submission made by the User.


  12. Limited warranties
    1. You expressly understand and agree that BSPL shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, fraudulent deals, for loss of income, goodwill, use, data, fines and expenses or other intangible losses damages, resulting from - the use or the inability to use the site/service; the cost of procurement of substitute service; unauthorized access to or alteration of your transmissions or data; statements or conduct of any third party on the site; or any other matter relating to the site; EVEN IF BSPL OR BSPL’S AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
    2. Any legal remedy or liability that you seek to obtain for actions or omissions of other Users or third parties will be limited to a claim against the particular Users or other third parties ONLY. BSPL shall not be responsible or liable for such claims.

  13. No warranties
    1. We do not warrant or represent:
      1. the completeness or accuracy of the information published on our website;
      2. that the material on the website is up to date; or
      3. that the website or any service on the website will remain available.
    2. We reserve the right to discontinue or alter any or all of our website services, and to stop publishing our website, at any time in our sole discretion without notice or explanation; and save to the extent expressly provided otherwise in these terms and conditions, you will not be entitled to any compensation or other payment upon the discontinuance or alteration of any website services, or if we stop publishing the website.

    5. Asiaworker.Com Is Only a Platform/Portal. BSPL Is Not a Recruitment Agency. Users Are Required to Follow All the Rules and Regulations of the Country/State Concerned, Regarding the Guidelines and Directions Issued by the Ministry of External Affairs, Immigration Authorities, Foreign Offices, Etc. And May Seek Guidance from Recruitment Agencies for Clarification/Help.
    6. BSPL Further Does Not Warrant That Its Service Will Be Secure or Uninterrupted; The Information, Text or Other Items Contained Within These Materials Will Be Accurate and Complete. Bspl May Make Changes to These Materials at Any Time Without Notice. Bspl Makes No Commitment to Update the Materials. No Oral Advice or Written Information given by Bspl and Its Employees, Licensors or the like, Will Create a Warranty; Nor May You Rely on Any Such Information or Advice.
    7. The services provided by BSPL are Internet-based. You acknowledge and agree that BSPL cannot control the flow of data between its servers, other portions of the Internet and your connections and computers. Such flow depends in large part on the performance of Internet products provided or controlled by third parties. At times, actions or inactions caused by these third parties can impair your connections to the Internet. Although BSPL will use its commercially reasonable efforts to take actions it deems appropriate to remedy and avoid such events, it cannot guarantee that they will not occur.

  14. Breaches of these terms and conditions
    1. Without prejudice to our other rights under these terms and conditions, if you breach these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may:
      1. send you one or more formal warnings
      2. temporarily suspend your access to our website
      3. permanently prohibit you from accessing our website
      4. block computers using your IP address from accessing our website
      5. contact any or all of your internet service providers and request that they block your access to our website
      6. commence legal action against you, whether for breach of contract or otherwise and/or
      7. suspend or delete your account on our website.
    2. Where we suspend or prohibit or block your access to our website or a part of our website, you must not take any action to circumvent such suspension or prohibition or blocking including without limitation creating and/or using a different account.
    3. Upon any cancellation/termination, you must destroy all Content obtained from this Site and all copies thereof. The provisions of these Terms concerning Site security, copyrights, trademarks, user submissions, disclaimer, limitation of liability, indemnity, and jurisdictional issues shall survive any such termination.
    4. All Users/Employers/Agencies registered on the Asiaworker platform hereby agree to abide by Emigration Act as stipulated by Government of India and any changes thereto. If any party is reported or discovered to be digressing from any laws, rules & regulations related to Employment or Emigration their user account will be suspended and/or terminated without any notice thereto.

  15. Breaches of these terms and conditions
    1. We may revise these terms and conditions from time to time.
    2. The revised terms and conditions shall apply to the use of our website from the date of publication of the revised terms and conditions on the website, and you hereby waive any right you may otherwise have to be notified of, or to consent to, revisions of these terms and conditions. OR We will give you written notice of any revision of these terms and conditions, and the revised terms and conditions will apply to the use of our website from the date that we give you such notice; if you do not agree to the revised terms and conditions, you must stop using our website.
    3. If you have given your express agreement to these terms and conditions, we will ask for your express agreement to any revision of these terms and conditions; and if you do not give your express agreement to the revised terms and conditions within such period as we may specify, we will disable or delete your account on the website, and you must stop using the website.

  16. Indemnification

You Agree to Defend, Indemnify and Hold Harmless Bspl and Its Affiliates, Directors, Officers, Employees, Proprietors, Independent Contractors, Consultants, Partners, Shareholders, Representatives, Customers, Agents, Predecessors, Successors, and Permitted Assigns from and Against Any Claim, Lawsuit, Demand, Loss, Damage, Expense (Including Lawyer Fee, Costs and Expenses) or Liability That May Result from, Arise out of or Relate To: (A) Acts or Omissions by You Arising out of or in Connection with This Agreement; (B) Intentional or Negligent Violations by You of Any Applicable Laws or Governmental Regulation, (C) Contractual Relations Between You and a Third Party; Or (D) Infringement of Intellectual Property Rights Including, but Not Limited to, Rights Relating to Patent and Copyright. Bspl Reserves the Right, at Its Own Expense, to Assume the Exclusive Defense and Control of Any Matter Otherwise Subject to Indemnification by You, in Which Event You Will Cooperate with Bspl in Asserting Any Available Defense. You Shall Not Settle Any Indemnified Claim Without Bspl's Prior Written Consent.

  17. Assignment
    1. You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and/or obligations under these terms and conditions.
    2. You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and/or obligations under these terms and conditions

  18. Severability
    1. If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect

Any claim or dispute between you and BSPL that arises in whole or in part from the service shall be settled exclusively by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 and amendments thereto. Arbitration shall be conducted in English/Hindi, at Pune, Maharashtra State, India. Parties shall bear their own arbitration expenses.
    2. You are solely responsible for your interactions with other Users. BSPL reserves the right, but shall have no obligation, to monitor disputes between you and other Users. You are required to lodge claim against the concerned, for recovering your losses or damages in case there is any issue. BSPL will not be a party to such User Disputes.

  22. Statutory and regulatory disclosures
    1. We are registered in trade register; you can find the online version of the register at URL, and our registration number is number.
    2. We are subject to authorisation scheme, which is supervised by supervisory authority.
    3. We are registered as title with professional body in the United Kingdom and are subject to rules, which can be found at URL.

  23. Miscellaneous Provisions
    1. This Agreement constitutes the entire agreement between the Parties in respect of the service and supersedes all prior agreements.
    2. This Agreement shall be binding upon, and inure to the benefit of, all parties hereto, their personal and legal representatives, guardians, successors, and their assigns to the extent provided in this Agreement.
    3. Nothing herein contained shall be construed to limit in any manner the Parties, or their respective agents, and employees, in carrying on their own respective businesses or activities.
    4. In the event that any provision of the Agreement shall be determined to be invalid, unenforceable or void, such determination shall affect only the portion of such provision and shall not affect in any way the remainder of such provision or any other Terms.
    5. If any of the Parties to this agreement fail to act with respect to a breach by the other, it does not waive its right to act with respect to subsequent or similar breaches.
    6. Neither Party will assign or transfer this Agreement or any of its rights or obligations herein, whether in whole or in part without the prior written consent of the other.
    7. All notices that are required to be given under this agreement shall be in writing and sent to the address of the appropriate Party as set out in this Agreement.
    8. The parties shall be released from their respective obligations in the event of natural calamities, national emergency, war, prohibitive governmental regulation or any other Force majeure event beyond the reasonable control of the parties. However, all payments due, have to be paid by the party concerned.
    9. Each Party understands that its obligations under this Agreement shall survive the termination of this Agreement.
